Physical and mental torture by husband and father In law what can I do

My NRI husband, father in law and sister in law all are divorcee's. They alleges the other party and ask for annulment and they got in past also. But this time I took a step and filed complained against involved people. I want to know is thre any way out where either they take me and my 8 months old baby or give one house and cash in alimony. He is earning in millions. And marriage is of 1.5 years. Thanks

If you feel that you have been cheated by your in laws and your husband and that there is no other way out to reach an amicable solution, then you can file a police complaint against them in the mahila police thhana concerned with the help of a counsel and state the Complete details of the atrocities that you have gone through. Thereafter there are other legal remedies which can also be used.

You can defend the proceedings of annulment as it cannot be granted on the facts stated by one party. You have legal right to live in your husband's house. You can opt for a settlement through court's intervention of getting one house and cash. Apart from this you can claim maintenance/ alimony from your husband by filing a petition for the same in the Family Court where you are living.

You can file for separation both mutually or bt court order. In both the cases you will get the maintainance.

You can file an Application under Section 125 of CrPC for alimony, further you can prefer an application under the Protection of Women from Domestic Violence Act, 2005 for alternative accommodation and compensation for the cruelty meeted out to you.

Dear mam;
Details given by you is not enough and minimum.
Wife share in property is 50% in all her husband’s residential properties,
While your share will be decided as per the court decision.
Owning you and your baby its depend on their mutual consent.
And The Hindu Adoption and Maintenance Act, 1956 also provides for the Hindu wife to claim monthly maintenance from her husband if she has no source of income for herself to maintain herself.
