Physical and mental harassment by inlaws need divorce .

After marriage got to know my husband is an impotent , he is diabetic, liver is damaged . He left the job jus aftr marige. Wen i asked about all this my inlaws tortured me mentally n physically. I m at my parents home from last 3 months. Its been 6 months to the marriage. I filed a case in women cell discussing with a lawyer. He filed the case under section 498a and matenance case. Plz confirm if we are goin in correct direction. I wan my stuff back and divorce from him. Also is there anything ican do to teach a lesson to them for my harassment so that they dont do this again wid any one.

Have you all this plea in 498A ? File a divorce case you want to. You must have file it earlier. Why are you facing such a troublesome situation. We can help you to put behind bars of your in laws. You should not bear their harassment. If your husband is impotent, this is a very valid ground for divorce. Make a list and expenses which your father had spent upon your marriage. You must consult any advocate as early as possible and file a complaint before police mentioning all facts regarding your marriage and cruelty by your husband and in-laws. You must mention each and every insident in that application. You must file that application before women cell and file a case before court after personal consultation from lawyer. You will get all your stri dhan back and of-course will teach your in-laws a lesson also.

As you have described here that you've filed a matter with the Women's Cell u/s 498 A you are heading at right direction. You can further file for divorce or file for Nullity off Marriage. For getting your "Stridhan" /Stuff back from your in-laws you can move an application with the investigating officer.

Since there is no cohabitation between you and your husband and he being impotent, you should file for annulment of marriage and it can be filed anytime and even get leave from the court for not waiting till 1 year from the date of marriage to file for divorce. Annulment of marriage will also save you from being called divorcee as the marriage will
Not be considered to have been solemnized.

yes u can file case u/s 498a ipc against your in laws regarding cruelty as well cheating meaning thereby concealment of facts at the time of marriage you can also file a case for maintenance u/s 125 crpc for grant of maintenance. futher if u want remarry u can file divoce prtition on the ground of impotency in 12c of hindumarriage act.
