Other party not appearing in court,delay in proceedings what to do

Hi sir. I m Hindu Brahmin girl and married in the year 2012. I stayed only one month at my in laws home and my husband used to harrase me physically so I decided to separate. Then we did notary divorce on 100rs. Stamp. But as I know I have to take decree through court, I applied in court for domestic violence case as my husband refused to take decree. It's been 1.5years of case in court, but still the matter is not solved. The only reason is my in laws are not accepting court appeal and refuse to come and present in court. Please guide me what should I do further or tell me the law regarding this.

The court will do exparte order as u tell ur lawyer to say judge to order for exparte order the judge will definitely do as if other matter will no be pending ,u must have put the case against him of 498A and maintenance so he would have given u easily

I will advice you to file divorce case in family court with a ground of cruelty. In a domestic violence case you will not get the decree of divorce and the petition you have filled for a decree on the basis of your notaries divorce you will not get till your husband will not agree. so file a divorce by your side.
