On what grounds wife can file for divorce

After 12 years of marriege on what basis a wife can file a divorce case?

It is such an open ended question because when there is a problem arising there comes the remedy in law. But if you ask generally any one of the following or combined together could be a ground for Divorce under Hindu Marriage Act. That is Adultery, cruelty, desertion, conversion to another religion, unsoundness of mind, virulent and incurable leprosy, Schizophrenia, Venereal disease in communicable form, presumption of death with the lapse of seven years. The other thing is Divorce under mutual consent where both husband and wife agree for Divorce.

Desertion Cruelty Impotency and Conversion of religion are the basis grounds for filing of divorce petition. If wife is seeking for after twelve years she should have shown some extraordinary hardship which she has been facing since inception of marriage or subsequent events. Wife can claim maintenance after the divorce. Revert me if you have any query. All the best.

You have to specify the reasons for taling divorce from your husband. Be it mental cruelty, physical cruelty, violence of any type etc. It would be better if you explain all the facts to your advocate.

She can file it on any ground available to her under the statute governing the marriage of the parties. It is better that the party sends a brief description of the problem that she is facing currently and tell us more about herself so that an appropriate advice can be given.

yes there r two kind of divorce one Is mutual consent and another is cruelty both party r agree then go for mutually other grounds r cruelty harassment desertion you can file partition before district judge regarding your gerrinvances
