Need information regarding validity of maintenance claim

Marriage was registered under special marriage act. Wife was under going medical treatment as she was having some gyano problem. But she left without consumating the marriage. After 1 year of separation I filed a suit for nulity. But she denied the charges and Replied that she was draged out of the house and I have filed the instant suit. She also demanded maintenance and accused me of taking dowry. Is she eligible to get maintenance as she has left at her own volition? What does instant case mean?

You are trapped now, your wife must have lodged an FIR under section 3 and 4 of DP Act as well as maintenance case under section 125 CRPC, yes interim maintenance usually you have to pay upon order passed by the learned cojrt but if your lawyer can block such payment nothing like it, detailed discussion is important.

Maintenance you have to provide even if she left at her own volition. You cannot deny it. But the amount of maintenance will be determined by court after considering both party's financial conditions.

Instant case means without waiting for 1 year. In your case such allegation is completely wrong.

Look Case is pending in between you and your wife. There are two Ld. Advocate contested it. A good numbers of time has already been over. You may put such type of question to your Ld. Lawyer. Therefore, further give you answer in this regard is fully divert your mind. Please concentrate the advise which your conducting Ld. Lawyer stated to you. Don't ask several persons for take advise. I do not know who is your Lawyer. But I think he will tackle your Case. Please believe him and faith upon him. why you take advise in this way, when you have an Advocate.
