Need information regarding divorce

I got marred last moth with hindu rituals but due to various differences i dont want to continue this marriage anymore. please suggest the way to out of this marriage as soon as possible. i do not want any type of alimony or any thing . i juts want to dissolve this marriage

Hello,

If you do not want to continue marital relationship with your wife and want to divorce her, file divorce petition under desertion ground ( if your wife left you 2 years back). If she left you recently and if you have completed 1 year of your marriage, file a divorce petition under cruelty ground stating no cohabitation and denying marital happiness as the reasons for the divorce. File the divorce petition in the jurisdictional family court where your marriage was solemnized or where you have last resided together. Insufficient information. You must first get issue a legal demand notice to your wife through an expert advocate who deals in family cases for rejoining you. Take the assistance of mediators, well wishers and your parents. Conduct meetings for taking her opinion. If she will not come then proceed to a court of law for seeking directions for getting her back to your family fold. File a petition in family court for restitution of conjugal rights for reunion.

Hello sir,

You can send notice to her through Advocate requesting her to come and join with your conjugal society to lead the marital life. If she will come well and good otherwise, you can file a petition U/sec. 9 of Hindu Marriage Act.

As per clients information,

As per Hindu marriage act, u can file for mutual divorce in the family court as per area jurisdiction.
U have to make petition in the family court for mutual divorce and on the first date of hearing the matter, court will refer the matter to conciliation process such process take six months.
After six months even after conciliation process fail and both party agree for mutual divorce before court.

In the first place as u have mentioned u are married as per Hindu rights
Thus Hindu law will be applicable...(assuming it to be true if not converted form any other religion)
Then in it case dissolution of marriage can only be done through court... U/s. 13 of Hindu Marriage act 1955,
And thus in it case you will have to file a petition for dissolution of marriage.. taking any of the ground mention under that section which would take it's own time.

However secondly u can also file petition for divorce by mutual consent.
It is also a time consuming process however faster than the earlier option...And easier to proceed with...
