Necessity of divorce when couple not staying together for over 2 yrs

I was married when i was 18+,but we dnt have any marrige prove.and we r separated almost 2yrs.we dnt have any cntct with each other.so is it important to take devorce from her?

Dear client,
As per your details I would like to suggest that not every marriages have prove of registration but still people get divorce and in your case you say there is no prove which is very difficult to say as the proof can be documentary and orally too , I would suggest to get divorce decree from the Court and if both the parties agree then file a mutual divorce under 13 B of Hindu marriage act.

Yes it is necessary. If you have not dissolve your marriage then you cannot remarry or you cannot claim the pension of divorcee daughter. So you have to dissolve the marriage by a decree of divorce(mutual/contested).

If there is no long delay, you can file petition for Nullity of Marriage which was solemnised when you are below of age for marriage. Provided that, you should contact with an Advocate for which he can give you exact suggesion after hearing your story in your mouth directly.
