My husband want divorce from me as soon as soon as possible

After divorce i dnt want any maintainance from my husband as i m gng to manage evrythng by myself . Nd i want my husband to take all d ornaments which he hve gifted me or watevr .so how to proceed for all such thngs

Dear Client,
You must get it written on a stamp paper nominal worth of Rs. 100/- duly inserting terms and conditions, that you need not want any ornaments from your husband and the ornaments that were given by your husband were handed over/returned to him. The same must be attested by two witnesses and it must be in presence of elders and mediators and the same fact should be mentioned in the Letter.

You can return all the ornaments through the court by submitting an affidavit in teh court and return the ornaments to the husband in front of the judge.
Your husband will need to acknowledge the receipt of ornaments by way of acknowledgement.

Mutual consent divorce is the easiest way to obtain divorce.
A mutual consent divorce will take about 6 months time.
Contested divorce takes nearly 12-18 months time.
For both contested and mutual consent divorce, parties should be able to provide proof of living apart from each other for a period of more than 1 year at the time of filing of case.

You can file a petition in a Family Court by engaging an expert advocate. But you must state the grounds on which you sought divorce. What are you and your husband. Whether you both are educated and employed. Why did you want divorce. Particulars are insufficient. Take Legal assistance.

Hello,

You both can file Mutual Consent Divorce (MCD) petition before the jurisdictional family court. The family court will give you 6 months of time for your second motion (appearance) and on the date of second motion, divorce decree will be granted. It is advised that you both arrive at a settlement pertaining to alimony and child custody etc before filing the petition. Incorporate the details of the said settlement terms in the divorce petition and file. All the best!
