My husband threatens if i stay separate he wont give money or child.

my husband always said if you stay separately I ll not pay a single money from my salary and also he said I ll take my child. He always drink and playing gambling what ll be the future of child, right know he is very bright student. Can he do that? What can i do?
Regarding staying separately, you are entitled to get maintenance from your husband for yourself and your kid. This right is vested in you under section 125 Cr.P.C.
Diovrce is not necessary for filing for maintenance.
Now with respect to the custody of the Child, generally the rule as set by precedents is that until the child has attained the age of 5 the custody remains with the mother. After that the husband is required to file a case to get the custody and the court after looking for the better future of the child will grant the custody accordingly.
