mutual divorce needed. How to proceed on it ?

me and my husband applied mutual divorce...the settlement amount was deposited in name of both side elders...before the final motion day...deposit was closed and taken dd in favor of me...my husband not attending the court and submitting dd...court adjourning the cae from two attempts...what i have to do next?..pls suggest me, iam very nervous

Hello,

Does your husband know about the date given by the court? If not, inform your husband to appear before the court on the next date. As he has taken the DD, he may appear. If he does not appear, the court may dismiss the case for default. If the case gets dismissed, you may need to file application under Order 9 Rule 9 of Civil Procedure Code for restoration of the MCD petition or file a fresh MCD petition or file for contested divorce claiming permanent alimony.

Your husband and you should be personally present in court for mutual grant of divorce. Not sure why your husband is avoiding court after obtaining DD . Pls chk with the bank whether your husband has really taken DD in your name
