Hi
You have to file petition for divorce before the family court.
You have to contest the maintenance application on the basis of merits.
She has less chances of getting maintenance of she is well employed and earning more than you

Dear client, you are very lucky as your wife is more educated than you ,and this more education will be the most benefited gift from her to you,as she is earning more than you hence she has no right for asking alimony and maintenance in the section 125 of crpc for what purpose maintenance is required is fully described as she is professional and earning more than you hence no right to ask about maintenance, for custody of child towards you we will show that she is suffering from depression as you are inferior than her as well as case of hypothyroid as her is probably 38 hence custody of child will be definitely offered to by the court as you are able to take of it more than her as well as less busy than her.if your mummy with you for the care of child that will be added advantage,as a professional I have guided you as above but as a father please contact me which are the reasons we can sort out in my service I have joined hundreds of separating families and which are enjoying colours (flying) of holi .thanks

Dear client,
It is settled law that if a women is earning sufficient amount in order to lead a good life in such case she is not liable for maintainance, but in case of one time alimony, it is the right of the women, no court will interfere in the matter, u have to amicably settle the matter, also you have to settle the question of custody of child amicably, however on the other hand you have a remedy to file a separate petition for grant of custody of your child, but it will be better if you able to get the matter decided amicably, don't forget to reduce the conditions in writing.
Thank you
