Mutual consent Divorce time taken and when can i remarry after divorce

According to hindu act,I am married to a person on october 10 2013 in temple without parents presence.Later after one year ie., Dec 15 2014 marriage is registered legally.But we have not lived together atleast for one day.After I realized what all had happened I am in a decision to depart from him legally.Even he is ready to depart but he is asking me money in return.If he agrees for immediate departion, how much time it would take legally to break the relation and when can I remarry to other person.Seeking for some advice.Please help me out.

Generally it takes 6 months to clear out all issues as by divorce by mutual consent. Generally court persistent to that couple must stay and live separately for an Year minimum. Make sure better arrangements of documents for such .

The date on which the marriage is legally registered will be the basis for date of marriage.if
In your case, even assuming that your husband is willing to grant mutual consent divorce, the process will take 6-8 months.
A contested divorce may take about 8-12 months.
Once the divorce decree is passed, parties can appeal with in 90 days from the date of decree of divorce.
So if you want to remarry, ideally you should wait for 120 days from the date of grant of divorce decree.

Dear mam you can directly file a divorce case and immedietly take the matter to mediation center their u both record your willingness and as per the terms divorce will be granted. It will be taking 2 to 3 months approx

Hi,

As you both are Hindus and more than 2 years have been elapsed since your marriage, you both can jointly file Mutual Consent Divorce petition before the jurisdictional Family Court for dissolving your marriage. Pay the money as he is demanding and file a joint MCD petition in the jurisdictional Family Court. The court will grant divorce on the date of second motion which will be after 6 months from the date of the first motion. Thereafter, you can marry immediately.
