Mental and physical torture by in laws how to file for maintenance

I am physically and mentally torture by my husband and my mother in low. I am sexually aboused by my husband. He give me physically torture everyday. I have 2 children. I want to live saprately with my children's in Indore my marriage was done in Delhi in 2005. I want maintenance for me and my children what can I do

You can complaint against your on laws in CAW cell and you can file the case of domestic violence against your in laws. And for maintenance you can fills a position insert section 125 crpc against your husband..

You can file a petition under domestic voilence for the physical and mental torture then u/s 125 crpc for maintenance for u and ur children. You can even claim maintenance and rwsidence in domestic voilence.

File a case before the family court for maintenance and another case under section 498 A of IPC. For all these purpose you have to engage a lawyer. Where are you living right now? It would be better to file a case in Delhi and create some pressure than only your in laws and husband will understand you. It wholly depend upon you, what you want ? Because once you initiate the proceedings, they may file case against you so be mentally prepare. It might take little time but you will get justice.Marital Rape is recognised yet although it is discussed throughout the country but still no law penalise for this brutal act. For this purpose we have to make case against your husband. Think properly and revert. Best of luck.

Hi, you may ask for maintenance under various provisions of law. The suitable jurisdiction of court is Delhi. You need to do it soon. If you file cases in Indore, there may be the problem of jurisdiction and transfer of cases to Delhi.
