Mental and physical cruelty by my wife

12-Apr-2023 (In Divorce Law)
Hi, I'm married in 2014 and she denied sex during first night itself. After an internal family counselling we both are together for some time. Now I'm having 2 year old baby boy now. She'll never speak to me with love or affection. she never care about me. we didn't have sex after my son's birth which is like more than 2 years from now. I'm planning to get divorce. She's a government servant. I'm a private working professional. If I apply for divorce, will it have impact on my parents property. Please advice me.

Hi
If you apply for divorce, your wife will not get any share of property. Only your son will be entitled to a share of his grand father's property.
Denial of sex is a ground for divorce.
But since denial of sex is difficult to prove in court, you should base your claim on the grounds of " Irretrievable break down of marriage resulting in many differences in marital life including denial of sex"
