Married for 35 years now want divorce and property can i claim it

Hindu. I want separation from my husband. But i want property where i also invested. But don't have proof . This for my future medical treatment . Can i get it?

I suggest you to file a mutual divorce petition for separation from your husband and at the same time you can ask for permanent alimony and immovable property for your future life. If your husband refuses to give then you need to file a contesting petition for divorce and maintenance.

Yes at present just file a case for maintenance and after the order or prior to that he may come for compromise and there you can demand permanent alimony or monthly maintenance and also ask for your property and go for mutual consent divorce.

Dear Querist,
For separation you should file a petition for divorce, with regards to property, if you have invested, you can claim the property, although there are no proofs for that you should show the circumstances and incidents to understand that you have paid the money to purchase the property else there is no way that u r spouse would have purchased it. You can also seek alimony/maintenance from your husband in your divorce petition.
