Marriage registered in India can divorce be taken from Hungary

Dear Sir, I got married to Hungarian girl on 26th January 2013 in Bangalore, India under Special Marriage Act. I'm in Hungary now and we decided to get divorced. Actually here we just got our Indian marriage registered so there was no Hungarian marriage papers signed again. Lawyers here want to get us divorced according to Hungarian laws so will this be valid in Indian Courts as well ? In case, I want to get divorced from here from Indian records also then what is the procedure ? Thank you so much. Regards,

Dear Querist,
Since you have your marriage registered under Special marriage act in india you can file a divorce petition from India. The procedure for mutual consent divorce is very easy, both of u should file a joint petition for dissolution of marriage after filing the case it is called after 6 months if the couple stick to the stand for dissolution of marriage the divorce decree is passed. On both the hearings the couple should be present before the court.

As per Indian laws including Special marriage act need to get the divorce at the place of marriage , last resided and then where staying together but only in India not outside , my friend I had a similar case , where the opposite party faced similar problem of getting divorce at USA but here Indian court refused to accept as MOU was such , we would suggest that you may kindly contact us for detail , so that proper legal remedies can be available to you .OFC : Adv Pankaj Kumar & Associates..

Yes if u get divorce in foreign country it is valid in India , u can get a divorce as per Hungarian laws and there is no problem as such. Divorce can be obtained in India or other country both or valid.

You can get a divorce done in Hungary as well, however for it to be validated, you need to file an execution petition and execute the divorce in India, without which the divorce decree will not be valid. If you have married under Special Marriage Act, you need to inform the same to the court and ask the court to look into the grounds for divorce under the Special Marriage Act and consider the same before passing a decree.
