Marriage Annulment based on non-consummation

04-Feb-2023 (In Divorce Law)
Hi, I married in November, 2016 and it was an arranged marriage. I have never had physical relations with anyone before marriage and after marriage I found it difficult to have physical relation and never happened after marriage. I then took consultation from some sexologist and psychologist in another country where I am presently working. He told that there are very little chance that this mental condition will improve and you shall better get out of this relation than living in mental pressure for whole life and keeping others stressed as well. Please suggest a quick way to get out of this relation as I have been in stress from months and this is affecting my professional life and health big time. Also this will be better for the girl to get out of this relation than hanging in the uncertainty. Can I file annulment of marriage from my side? What proof does the court need regarding this? What is the minimum time that will be needed to close this case? Please suggest. Thanks

As u said u live in different country so it is a matter of fact that where your marriage was solemenised that is in which country as it might be possible that laws are not same
But in context to Indian law in Hindu marriage act you can file for divorce by giving reason for your physical condition

Yes, you file the case for annulment from your side mentioning the details as discussed above. So the both of you can live separately & happily. Your medical docs can help you for same. .

You cannot get this marriage annulled by the Court, there are no sufficient grounds. Because, you said you found it difficult to have physical relation, this does not mean that you were actually incapable of having physical relations. Even if you get annulment of marriage on the ground of incapacity to have physical relation, then this cause of incapacity will be written in the judgment and in the decree, which will be a life-time blot for you.

Better you go for Divorce by Mutual Consent after November 2017, the whole process will take only 6-7 months.
