Man married with fake identity and now blackmailing girl for custody

One USA citizen has cheated one Indian girl in name of marriage.They have a child. Recently this USA citizen is disclosed that the identity he has told is fake.He has met the girl through matrimonial site. Their marriage is not registered yet. That man is threatening the girl to give custody of her child to him and correct the father's name in the child birth certificate, otherwise he will hire abest lawyer in India and will prove that all the fault belongs to the girl and her family.He will sent her and her family to jail and take the full custody of the child.
If he cheated you by giving fake identity then you can register a police complaint against that person.
With respect to the custody of the child, generally the rule set by the precedents is that the custody of the child remains with the mother till the child has attained the age of 5 years.
Thereafter for the better future of the child the court grants the custody to the parent with whom the court feels the child's future is secure.
