Maintenance case not decided yet if I start working will I get?

HI.....When i seperated from my husband i wasnt in the right frame of mind to work hence i filed for maintenance as had lot of responsibilities on my head.But its been almost ayear but the court hasnt decided the maintenance as he does not come on hearing nor submit the proof of his income.But now i want to start my work again so will it be a purgary if i start work again because i have heard we cant claim maintenance if we are working.But the case has already been filed now so can i take it back because if the court comes to know that i m working,it will be felony on my part.

Dear client as u have already filed maintenance so let the decide case. If u withdraw then u will loose yr right for future. It is duty of yr husband to show the court that u r working. It will take time to get him knowledge about yr employment. Try for speedy disposal of yr case. For any legal help call me

no, not at all. perjury is if you are giving false evidence knowing it to be false. in your case situation is completely different. it is settled law that even if you are working it will not affect your right of maintenance. still if you wish you may inform this fact in writing to the court by way of filing pursis.

You have two options 1) to apply to the court to decide maintenance case in your favour(Ex parte) as your husband is not appearing and get the order executed against your husband.
2) to withdraw the maintenance case and get employed and earn.
