07-Apr-2023 (In Divorce Law)
Hi, I had applied for mutual consent divorce in Sept 2016 and was granted divorce after a 6 months waiting time in March 2017 this marriage was under special act of marriage. I will receive my court decree in 3 months from now. But i am speculating slight delays. I am getting remarried under muslim law in August. Is it possible to have nikah before i get my court decree and then register this marriage later incase of delays?

Madam

When the matter is pending you cant go for other marriage. The atmosphere of the whole case may turn by some other way. Please wait for some time till to close earlier cae. Once it was closed you are liberty to marry any one.

Even in Muslim law also there is a clause that earlier marriage should end.

Please wait for certain day till the order you receive.

Irrespective of the catastrophe of good ,bad and ugly your marriage would be Void unless and until you get your decree by a competent court ignorance is not permissive. No you are committing an offence by remarrying without a valid procedure enticed by the court of law .

First your query does not disclose as to which religion you follow and which is the personal law that governs your matrimonial life.
Grant of decree for divorce is the point for considering the consequential events. Obtaining the copy of the decree is not.
it is possible to have nikah before you get certified copy of the court decree and then register this marriage. Have a happy married life at least in this new marriage.

If it is a Mutual Consent Divorce and if both the husband and wife has consented, there is decree that will be drawn by the court after the madatory waiting period of six months. If the mediation report is submitted and decree drawn by the court, you can marry without waiting for the copy of the decree
