09-Jun-2023 (In Divorce Law)
Is it possible to get divorce without staying separately for 1 year? Ours was love marriage and it has been 8 years, she could not go to her parents house as her father boycotted her as we had marriage against their wish. She earns money by doing some temporary jobs and not so much mature even now that I could make arrangements for her to live separately.. She lies to me and has had affairs in the past which I caught by checking her phone so whenever I say that lets get divorced, she says she would go away without telling me and causing mental stress to me. Please help me, what can I do end this relationship?

See in your case, we can file the petition for judicial seperation and after one year then we can file the divorce petition in the court. Provided in that period of one year there must be no cohabitation between the parties and must not enjoying the conjugal or marital rights.

Yes, it is possible to file for a divorce without staying separately for a year. The divorce can be filed on any of the fault grounds. From the facts stated by you, mental cruelty is one of the grounds. Detailed opinion can be given only upon knowledge of full facts of the case.

A separation for one year may not be required if you opt for divorce by mutual consent. Please consult a lawyer in your town who can guide you through the process. Do not indulge in character assasination
