Is infertility or is impotency the ground for divorce ?

17-Nov-2023 (In Divorce Law)
I'm harassed by in-laws because I'm infertile. Husband is too scared and attached to support me. Can they go ahead with second marriage or surrogacy legally without my consent? They threaten divorce if i cannot conceive. I'm Hindu.

Infertility is not a ground for divorce but impotency is. Just because a lady cannot bear a child she cannot be divorced. Your husband cannot legally marry another women unless he has divorced you. There is no law for surrogacy in India.

No it is not ground for divorce , impotency is with respect to a man , impotency is not related to women if you cannot conceive he cannot get a divorce on that ground, further they cannot go for second marriage legally without obtaining divorce from you through court. And if they get married without obtaining divorce then it amounts to Bigamy and which is an offence and you can file a criminal case for it.
