If I dont appear in court for divorce summons what will happen

20-Dec-2023 (In Divorce Law)
Hello I got married in June 2015 and my wife used to come frequently to her parent house after marriage in Lucknow. I am from Amritsar. She demanded money several times for her family aand at times we helped her family with cash. IN between she got her younger sister married and demanded 50k to help her family in marriage and said she will return it. Above all she never allowed me to make a physical relation saying she feels huge pain when she goes for physical sexual contact. After 1 complete year of marriage she left our house with her father. Recently we got a notice for 13 HMA to appear in court. I was not avaible at house while summon was receieved. Later talking to lawyer , he mentioned as the case is filed for 13HMA and seeking divorce, so if we do not appear before court , possibly it will be ex parte for divorce and wife will be granted the same.

The main purpose of summon is to ensure the appearance of opposite party or to inform the opposite party regarding that a case filed against you and in case you will not appear before the court, the case will be decided ex party because summon is already served upon you.

If the summon has been received , court will send another summon or publication in newspaper thereafter it will give chance to your to prove her accusitions if court accept them she will get divorce however at that time you can go in court and appeal against the same. Which will take approximately 2-4 years.

In case the court is distant from your place or is in different state, you can prefer a Transfer Petition before Hon'ble Supreme Court seeking transfer of the Case under Section 25 of CPC. Supreme Court May transfer the same.
