If Husband Leaves A Spouse For A Period Of 4 Years n not willing to provide divorce to leave her rest of life peacefully and a spouse is willing to accept a divorce she is having a child of 6 yrs ....if she files a divorce by her willing she is afraid of loosing her child weather court decide to leave her child for her husband ...may I know wts the solution
I f husband has left ( deserted ) wife ( if she is not earning) he cannot deny maintenance to her and deny divorce too. She can file for a divorce. Also, in regard to custody of child, Courts take into account opinion and wish of the child also.
