I want Divorce. But I have been made emotional fool.

My religion is Hindu. My husband married me in 2014 later I got a Tumor in my pituitary gland he left me in my parents house for surgery and never took me back . And when I was sick use to provoke me and when I replied I did via email. So he planned everything and left me. I suffered with 2 surgeries and radiotherapy . And I'm alone now managing everything without a job. Not able to work also. Husband has made up a story and false suicide cases against me in kolkata. Also I'm a masters from UK. So he is telling won't give any maintainanice. He is just leaving Me on grounds of emails and bad behaviour . That was due to surgery and they proving me when I was sick . Also he had planned everything and I had no clue. I need justice I'm just 30 years old. Ppl can't play with my emotions and leave me coz of some emails I wrote.
Hello, husband is liable to pay maintenance under section 125, incase you are unble to maintain yourself, he should pay monthly expenses as per the law. You also can file 498a and domestic violence case against him.

In order to best understand the issue, I would need to go through the contents of the emails. However, even if you are educated, the fact that you are undergoing medical treatment is a good enough explanation for your not being able to work and hence, prima facie, you would be entitled to maintenance.

You should initially file a case under section 125 crpc seeking maintenance. Thereafter, when he starts paying some amount, he would probably come to terms and settle for a mutual divorce with a final settlement offer. You need to file case under Domestic Violence Act and first seek maintenance and other redressal. You download the soft copy of the said act and since you are educationally qualified, read the same.
