i have finished 1st motion of divorce second motion not apply
24-Aug-2023 (In Divorce Law)
i have finished first motion of our divorce,but some reason secend motion we can't apply.kindly advice can we apply for secend motion or we we started again the same pattorn.Also please confirm if we seperate for more then 6 years, it can be automaticaly assume as divore or not.if yes so please confirm it can required any legal formality or not.
In regards to your inquiry if the first motion has happened within last 18 months then it is valid otherwise the process will have to be started afresh... Fact of your living separate for more than 6 years does not grant you automatic divorce.
You need to go through the procedure. If 18 months has not passed from date of filing of first motion, you can move second motion. Else you need to file both motion with six months gap in between two motions.

Well as pet your question you alredy got first motion of divorce but not complete 2 motion. It is mandatory to complete 2nd motion for law is clear after ompletinf first motion you have to apply second motion up to o e year othet wish divorce process will not completr for furthet query you can contact me or for filiifiling second motion or legal advice

After the first motion second motion can be moved anytime before 18 months. And there cannot be automatic divorce irrespective of innumerable years of separation. Divorce decree from a competent Court is neccessary to effectuate divorce.

The time between fist and second motion is 18 months (maximum) if such period has been lapsed you have to start all over again
if, you within 18 months of your first motion you can go ahead with second motion,
