I have a Divorce matter with 498A being threatened

Two weeks back my wife parents asked for 5lakhs for mutual divorce. unfortunately, my parents refused to give that amount. Recently, they filed a complaint in police station in that complaint she never mentioned about DV and Harassment. After counselling, my parents still not agreed for that amount. Now, there are trying to file a new complaint on me under 498a, DV. I have first report copy with me and I would like to know whether this is possible. Also, advise me how to proceed further.

Hi,
If your wife give a case under this section (498a ) there is chance to harrest your whole family.
So maximum try to bargain your wife deal .
Otherwise better you accept your wife deal.
Becouse your wife have a full rights to file a case maximum 3 or 4 .
If she file a case to you it take more time and also money . Also you spoil your age,life,etc.,
Better you accept your wife deal and apply mutual. After that start your fresh life.

Earlier complaint would help your case. In case if they lodged a new complaint by making false allegations then u can approach the High Court to quash the second complaint. While approaching the High court to quash the false complaint you may refer the earlier complaint lodged by your wife to prove ur genuineness.

If she files cruelty against you then you have to face this issue. But when the girl is not willing then it can be closed through offline and Mutual good future betterment. If you need more assistance call me

Sir,
As per my understanding you have copy of first compliant copy, ok, you should be alert whether the Police is going to register FIR against you. You can tackle the same by filing petition seeking anticipatory bail. If they proceed DV case also you have to contest and be prepared for the maintenance/alimony ordered by the court.

If you have really not taken any dowry or have not done any cruelty to your wife, you dont have to worry about any number of false complaints.
