I was subjected to taunts regarding marriage arrangements and dowry by them. I conceived soon after marriage. Our relation was getting strained rapidly and things took a ugly turn when my husband thrashed me when i was three months pregnant. I left his house and came to my hometown . I gave birth to a son while staying with my parents.Currently we have no communication with each other. 1 there are no efforts on his part aiming to sort things 2 repeated attempts from our side have gone down in drain as they dont cooperate 3 my parents are bearing all the expenses including medical expenses of me and my child. My husband didn't even offer a penny. 4 there has been physical and mental abuse.Baseless questions has been raised character and child's paternity. Question 1 what legal options are available to me If: a) i still prefer reconciliation. ( since a child is involved ) b) if they don't agree with the above what other legal option i have. I am a hindu female.
Hello, I really hope you guys reconcile. But, so far as your present scenario is concerned. I think you file case for maintenance against him. Its his duty to maintain you n your child. Also, you can file case to restitute your conjugal rights. Anything more, write back.
Madam you can file case under section 9 of Hindu marriage I. e. Restitution of congual rights. By this the court may ask your husband to take you back. If that doesn't work you may find application under section 12 of Domestic violence Act and claim room in share house hold

If one of the spouse is not willing to live with other for whatever be the reasons No court can force him or her to live with other by force. Reconciliation is the best way to sort out matrimonial disputes. If it fails, then you have the option for filing divorce, seek maintenance for yourself and your kid and file complaint for thrashing and dowry borh under IPC and DV ACT.
