I don't want to give divorce to my husband what can I do

Hello sir, I am a sikh girl married to sikh guy for one and a half years and also having 4 months old daughter.he is captain with airlines and a home maker.After few months of marriage we have disagreements on many things,fought several times.he and my inlaws tortured me physically and mentally.They put spying software in my phone and recorded all the conversations for last one year.when i came to know about thiis i left his home and came back to my parents with my daughter. He wants divorce and if not given he wil convert into islam and will do 2nd marriage. please help me. is it possible?

Law is quite clear that if your husband marriages some other girl without getting divorce from you, he would be guilty of bigamy punishable under Indian law. A hindu doesn't become entitled to remarry by converting to islam, he may convert to islam but cannot remarry.

You have all the options to file cases against your husband and in-laws for various reliefs for which you may contact me. You may also defend the divorce proceedings.

There are two way of get Divorce, Mutually and Contested.
As you are not indented to give him divorce, he certainly apply for Contested Divorce.

However, the general practice into the court to save the Institution of Marriage, and all possible effort can be done by the parties and the court to save it.

You, can submit to the court through your advocate, (it would be better for your), that you dont want to Divorce and want to save your marriage life for the sake of you and your Daughter.

His statement, converting into Islam, shall be illegal any conversion with intended to Marriage or cruelity to other is bad in law ( according to various ruling of Hon'ble Supreme Court)
