I am living in Kuwait and want divorce as per Indian Muslim Law

I am Muslim living working in Kuwait My wife is living with her parents She doesn't want to come with my father house She forcing me to live with her father house or take a home near father residence Before two time we had meeting with our masjid and her masjid member But no solutions found because of her father rude behavior he doesn't want to divorce with sariaya law he went to police station and wanted to file against my family. Then police officer compromised And now same thing happened she again torture me I don't want to live with her now I want to divorce her Tell me how ? Best solution
Divorce can be given to wife or husband under Dissolution of Muslim Marriage Act. You can file a case for divorce before family court of your district . In any matrimonial case there are multiple remedies available to wife . So being a husband you have to be very careful at the time of filing a divorce case.
There is one inherent factor in law that is called equity.
If you had to live in Kuwait leaving your wife in India then it was of no use of marrying a lady in India and then compel her to stay away from you and live with your parents. If it is for a short period the matter is different.
But it appears from your question that you are settled in Kuwait. Then instead of divorce you should think to get her to Kuwait and live with her there. In my personal opinion living in Kuwait by husband leaving his wife in India with his parents is itself cruelty on wife. So if it is permanent feature that you want to live in Kuwait leaving your wife in India you should try for mutual divorce by paying her one time alimony. It would be the best option for you to get divorce in the circumstances.

You can divorce your wife if she is behaving badly to u as it amounts to cruelty. Their is a dispute going on in India regarding triple talaq but you can divorce as per Muslim law which will take 3 months , and on certain date fixed you will divorce your wife saying that you are giving talaq , then on next month after 30 days you will again say that and then again after 30 days you will do the same in front of qazi and 2 witnesses. The whole proceeding be drawn on paper each month. In between you can resolve your dispute with your wife and if you cannot you can proceed. After the whole proceeding you can get the said talaq be declared by Court by filing a suit for declaration in family court.
Why don't u pronounce triple talak to her which is as if now prevelant & exceptable in Sunni laws u can dissolve ur marriage as per dissolution of Muslim marriage act 1939. There r no of points on which u can prepare ur case & file the suit. For more information u can call me
