Husband used false information to get married how to annul marriage

My sister got married last July and her husband gave us a singed biodata where he stated that he s a marine engineer and born in 1984.After marriage she discovered he was born in 1982 and when asked he said it was a clerical error.Later our brother found gis Resume which states he is a seaman not an engineer ( lot of other lies too).we are going to file a case for annulment of marriage. Pls advice what points he can put for defending himself.

You cannot annul the marriage on the ground of false information..However you can file the petition before the family court for the divorce on the ground of Mental cruelty.If u could prove it definitely you will get it.

one thing-it should be filed with in one years from the date of marriage.
please entrust the case, early as possible before the 1st anniversary.
at any rate ,it should be filed before 1st anniversary.
please discuss with the issue with your advocate.

In this matter, if there is no other issues as to his behaviour or so, you can develop him up to your mark, rather than fighting and ruining your sister's life. If there is problems, your sister can file a Petition for Divorce, Petition for return of ornaments and other articles and cash along with another petition for maintenance . But you must be well prepared to produce the documents, that you are cheated. first of all, the above mentioned fact is not a fact for divorce, its not even comes within the preview of the act, so tat means you have to create other tactical changes and events fro getting a divorce. You have a weak side yet a better drafting of the petition can save ur daughter. BE open to your lawyer about the need and circumstance, N for him to defend, on the above mentioned facts n circumstance its an easy job for him. But my personal recommendation since they got married you must should think on more options including settling the matter between them and amicabily look forward to it, Talk to your sister n arrive at a decision. Life is short, think THRICE n do that right for her future...

Fraud marriage is defined in Section 496. The Section 496 can be used to convict a person who, with the intention to defraud or to commit fraud and knowing that the marriage ceremony is invalid, performs such a ceremony. This section punishes such fake or fraudulent marriages.
