Husband tried rape me after ten days marriage , what can i do?

I got married 10 days before it was a arrange marriage thats why i asked my husband for some time to settle down and to accept him as a husband bt last night he tried to force me for sex and when i apposed him he has bitten me very badly and attemed rape now i dont want to spend a single day with him i want divorce from him i want to know how long it will take to get divorce and i want to fill case against him also what are the charges i can file against him and for how long he will go to presion

First time you tell me why you not interested for your conjugal relation?
Whether your marriage was arrange or previously relation with your husband?
In divorce case what you want to get?

Immediately file a 498a and a 377 case with the police and domestic violence. Also get in touch with the women's commission and also get yourself medically checked so that forensic evidence showing bite marks leading to grievous hurt can be shown. You can also file for assault and grievous hurt.

File a criminal complaint against your husband under section 498A of the IPC. Unfortunately, our laws do not recognize marital rape as an offence, so spousal torture is all that you can charge your husband with at the moment. However, divorce will take some time as Indian law does not allow speedy divorces.

Look, if you became a married women. your husband co-habit with you, it is not fall under the definition of Rape. Yes, it is admitted that, you are not willing to co-habit with your husband right now and he apply force upon you without your choice. You can have right to file Nality of Marriage before the District Judge within 1 year from the date of marriage and get Decree of No marriage, because the marriage was not consummated.
