Husband torturing mentally and physically how to get divorce

Dear sir/madam,I'm a 24years Hindu girl.In a month I'm going to complete my first year anniversary,it is an arranged one but nothing is going on right between us,no proper support from him regarding my career,from day1 onwards I'm facing problem with my husband. He gives me mental torture through his words and actions which is unbearable as a women,he always says that he is going to give divorce and always says and behaves that he only wants me for physical relation,he never talks to me and he don't even have self neatness for all these reasons I never allowed him for physical relation,I know it is wrong but the way he behaves with me makes me to be like that,for me relation means heart to heart.I always asked him to have some friendly relationship so that we can move closer but he never accepts it and even physically I got abused as he once beaten me.I can't take it anymore.what to do now how to proceed​?Do I get Justice in favour of me and get the ​money we spent for the marriage?

You can file a complaint against your husband under Domestic violence Act for abusing you physically & mentally. You can also seek monetary compensation for such abuses and also maintenance. You can also seek return of articles, return of dowry & gifts . You can file a Petition for divorce under Hindu Marriages Act only after one year of Marriage.

Particulars are insufficient. You did not mention about your education details. If you are educated woman why don`t you try for job and rely on your own feet. You did not mention about your husband job and education. Whether are there any financial difficulties. Whether he is not providing money for your necessities. First of all you must put your dissatisfaction before elders and mediators who arranged marriage. Take support of your parents. If you want to establish your career, you must go to your parents` house and try to go ahead with your further studies and get job and financial stability. Try to change him through your conveying messages and through elders and mediators. Try to have self reliance. Even if your husband did not change, you go for judicial separation by engaging an expert legal assistance.

If possible, initiate talks with your husband and convince him for a mutual consent divorce and demand him to pay you a lump sum amount as one time settlement. If that happens, it will be good as it is faster and you will be out from the mess quickly within 6 months. However, if your husband is not ready for mutual consent divorce and not interested in paying you in lump sum and persisting with his cruel acts, file a case of domestic violence against your husband and seek various relief as separate accommodation, protection order and compensation and yes, you can also claim for the money spent on marriage etc and once you get these reliefs, file for divorce. Or, you can file for divorce even without filing the domestic violence case and claim for permanent alimony and get rid of your husband.
