Husband tortured me married in 2005 havent met for 10 years divorce

I had love marriage in 2005. But my husband was a complete psycho and always tortured me. We didn't live together much.I have a baby also. He never lived wid his baby also. We had dowry case also in hope dat due to fear of law his behaviour will change. But no use. And I always lived with my parents. We have no connection with each other for all these years almost 10 yrs.I studied again and got job. Now m happy but want divorce or separatarion order so that marry someone else wid my baby. So plz suggest me how soon it will be possible if he doesn't agree for mutual divorce. And he still wants to disturb my life. So just suggest Me ways to get out of all legal formalities. I just don't want dat person again in my life who doesn't know even d name of his baby n just want to torture me and want to get financial benefits from me. Plz suggest me to have divorce as soon as possible. It's been more than 10 yrs we haven't even met each other.

As per divorce u file ground u put make it easier for divorce.As u are living seperated for 10 years which is long period .There are other provision to make divorce easy but u have to go with those provision

Section 13 of the Hindu Marriage Act deals with the grounds on which the parties can seek a decree of divorce from a competent court having jurisdiction to entertain such case.. now from where i can see your case you can simply file a divorce petition on the ground of desertion .
The expression ‘desertion’ means the desertion of the one by the other party to the marriage without reasonable cause and without the consent or against the wish of such party.

I would like to inform you that you have one option for file divorce petition and take ex party order from the Court so that you can easily split the conjugal relationship from your husband. If you can shows mental disorder or psycho disease with medical support then it will easy for you split the marriage in short span. However, under Hindu Marriage Act you have right to file divorce.
