Husband threw me out and want divorce what can I do

Hello.. m into distputes from August 2015 with my husband and father in law bcoz of my husband's extra marrital affair. I am married before 9yrs and my son is of 8years.. on 3rd jan 2016 my husband amd father in law throw me nd my son out of the home.. now father in law filed a suit of restrain on me nd my husband and husband is demanding divorce. M a housewife, my parents are retired. Plz guide me what should i do now?? I still love my husband and want to go back to my home

Being a legally wedded wofe you can claim all the rights agaisbt your husband. Right tk shelter and maintainance is your legal right and you can contest dor that. If he is giving you divorce then he also has to gv you alimony and other benefits

You should file an application for maintenance under 125 Criminal Procedure Code and Hindu Marriage Act. You should also file a case under Domestic violence Act for providing you a residence. You will also have to defend yourself in the restraint proceedings filed by your father in law.

you can file a Petition for Restitution of conjugal rights under which you can pray to live peacefully with your husband in the matrimonial home. In the mean time you can look for an option to file a petition for monthly maintenance for yourself and your son. so better consult a lawyer.
