Hello.. m into distputes from August 2015 with my husband and father in law bcoz of my husband's extra marrital affair. You should file an application for maintenance under 125 Criminal Procedure Code and Hindu Marriage Act. You should also file a case under Domestic violence Act for providing you a residence. You will also have to defend yourself in the restraint proceedings filed by your father in law.

you can file a Petition for Restitution of conjugal rights under which you can pray to live peacefully with your husband in the matrimonial home. In the mean time you can look for an option to file a petition for monthly maintenance for yourself and your son. so better consult a lawyer.
