Husband remarrying without divorce what action can i take

I am Hindu .I am contesting divorce case since 2014 filed by husband under HMA 13(a).It is on the stage of arguments in sec24.But now I came to know through my nears and dears that my husband is getting remarried in a month without taking divorce.I am not aware when,how and where.What can i do at this point of time and can I restrict him to do so.

You can file case of bigamy against your husband and this is non cognizable offence as such no FIR can be registered by police. You have to file pvt criminal case for it. You need criminal lawyer for it

Any action at this point of time would be a futile exercise as you are not having any substantive proof of the alleged fact. You do not need to take any steps to restrict your husband from remarrying, as law will take its own course if he does so. If your husband contracts marriage without giving you divorce/ during your lifetime (if not divorced), he will be liable to be punished U/s. 494 of the Indian Penal Code. Under the said section the accused is punishable with a imprisonment of upto 7 years and shall also be liable to fine.

At the given stage, you may hold him liable for bigamy. This is owing to the fact that he can not marry another woman, while he is still married to you. As per the law, he is married to you until he obtains a decree of divorce from the court of law.

You may be able to prevent him from committing the same, by telling him that you would file a criminal complaint if he marries, until the decree of divorce is finalised and given in his favour.

Since you came to know through your nears and dears that your husband is getting remarried in a month without taking divorce. Get assistance from the detective agency so that full proof of marriage can collected and some photographs. Thereafter you can file a criminal complainant of bigamy against your husband and proceed accordingly.
