Husband not staying with me for last 1 year how can I file for divorce

I am a 36 year old Catholic converted into Muslim who married a Muslim at Bandra court 2 years ago thru a lawyer in a customary marriage ceremony by a court appointed Kazi under Islamic law.I need a divorce and I'm unsure of whether my husband will give me a divorce or not.he has not been living with me for a year and a half and financially not supported me ever.I do not want any alimony and have no child.please advise

Dear client as u did marraige according to Islamic law so u have to get divorce according Islamic law. Apply for khula to kazi first and take certificate from him. Once u get khula then apply to court for divorce. For any legal help call me

You have to engage a advocate and proceed for filing divorce after issuing him a notice. If your husband gets ready for mutual consent divorce than its good but otherwise you will have to file a petition for divorce. As you don't want any alimony and as you don't have any child and as he is not cohabiting with you since a year, i don't think any reason why your husband will not be ready for mutual consent divorce.

You may file divorce petition before district court under the relevant provisions of law. You my also dile a criminal complaint under domestic violence act before magistrate court.by filing these proceedings surely you may get certain relifs you are need of .
