Husband not living with me can i apply for maintenance?

My husband living with a other women for three month and not lives with me and my two son, he want divorce but l do not give him divorce l want monthly maintenance for me and my children, He is an central government employee DAD office pune . And I want to live with him. What legal action can I take for to save my marriage

yes you can apply for maintenance by filing a 125 CRPC case wherein you can seek for maintenance for both the children and the mother. Before such you must also inform the local police station for your safety .

Hello,

You should file for restitution of conjugal rights. You also can initiate a maintenance petition. There are other measures also which can be taken but for that the case should be discussed in detail.

if your husband deliberately neglects to maintain you and your child/children and if you have no such earnings to maintain yourself and your child/children...

You can file a maintanence case against him under Domestic Violence Act for yourself and your children and for other expenses. You can also file a case for restitution of conjugal rights for getting back your right as wife.
But off the track its sorry to state that legaly you cannot compel anybody to save his marriage and bestow love and affection to his wife unless and until he too has the same feelings.But still we must not loose hope and try our level best.

you can apply for maintenance under section 125of Cr.P.C for all of you and also file an application for protection, shelter and maintenance under Protection of women from domestic violence Act. A minimum period of two years desertion is needed for divorce on the ground of desertion. Please first decide what type of relief you seek -monetary or punitive. Consult with an expert he will properly guide you according your scheme/ need.
