Husband is threatening to drag me to court what can be done

I am living separately from my husband since last year because he cheated on me and harassed me mentally and physically. Husband has filed a case under section 9. And now he is threatening to file for visitation rights of our minor son before divorce. Can he ask visitation rights before divorce

Child belongs to both of you i.e. you and your husband. So he has got right to see the child. The competent court may allow him visitation, at some reasonable time and place. You may claim travelling expenses for the place of meeting.

You can contest the cases filed by him and proved them wrong. You havte to fight the cases to prove that the allegation levveled by him are wrong. Visitation rights may be granted to him by the court as ut depends

yes, he can ask for visitation right being natural father. However, you can oppose tom that on the grounds of his conducts etc. you have not mentioned as to whether or not you have filed your response to his section 9 petition for restitution of conjugal rights. your response could be also ground for opposing visitation right application. Have you filed for divorce?

As a parent he can file visitation right even when the Divorce Petition is pending. The court may taking into consideration of the welfare of the child may grant visitation right. But you can still contest the case on visitation right. At the worst outcome you can choose a public place for visiting your child by your husband for once in a month or like that. Have you filed any case against him or not. If not you can file for divorce on the ground which you have mentioned above and also demand maintenance for both of you.
