Child belongs to both of you i.e. you and your husband. So he has got right to see the child. The competent court may allow him visitation, at some reasonable time and place. You may claim travelling expenses for the place of meeting.

However, you can oppose tom that on the grounds of his conducts etc. you have not mentioned as to whether or not you have filed your response to his section 9 petition for restitution of conjugal rights. your response could be also ground for opposing visitation right application. As a parent he can file visitation right even when the Divorce Petition is pending. The court may taking into consideration of the welfare of the child may grant visitation right.
