Husband is not attending his office can I claim maintenance ?

I have three children, Due to alcoholic nature and domestic mental and physical violence of my husband since last one year staying with my mother. Should I file a maintenance case? Or move forward in my life. one thing which I want to tell u that my husband is working in a PSU but since last 6 to 7 month he is also not attending his office, taken loan from his PF also that's why I am asking your suggestion is there any benefit by filing maintenance case against him.

You have a right to maintenance from husband for yourself and your kids under section 125 of Cr.P.C. and under the hindu marriage act.
There is no necessity of being divorced for getting maintenance from your husband.
