Husband is an alcoholic.How to get divorce

Hi i got married in June 2016. we separated in the month of November due to few behavior issues. (excessive consumption of alcohol). I am looking for legal advice. i cant live with him any more. One more issue is he has got all my jewels. i think he has pledged them. They are refusing to give it back. Pls advice.

Hello,
If you decided that you can't live with him anymore then you can file divorce and maintenance case against him. You can file divorce on the ground of cruelty where you can also seek Return Of articles in the Hmop petition.

Mental cruelty is also a ground for divorce. After one year of marriage you can file divorce petition on the ground of cruelty. You could also file a petition for return of articles to get your articles from your husband.

Petition for divorce can be filed only after one year from the date of marriage. There is one exception though, which I would rather not discuss here.

You can file for divorce in the appropriate Court with jurisdiction in June 2017.

As far as your jewels are concerned, since (assuming) it is your Sridhana property or your own property, you are entitled to ask your husband to return these jewels.

Have you decided not to live with him? If yes, then you must contact me for further details to file a petition for divorce, Petition under Domestic Violence Act and for maintenance. In that you can also ask for return of the jewels and for payment of the marriage expenses etc. You can also file a complaint with the local police to get back your jewels.
