Possibility of winning the case will depend upon how you defend the divorce case.

Your husband will have to prove grounds for getting divorce according to section 13 of the Hindu Marriage Act, 1955.

If you succeed in "disproving" all the grounds taken by your husband, then your success in the case is guaranteed.

Such divorce cases totally depend upon proving and disproving the grounds for getting divorce. If the petitioner successfully proves grounds for getting divorce, then the Court will grant decree of divorce, but if the defendant disproves grounds taken by the petitioner or if petitioner fails to prove his case then the Court will not grant decree of divorce.

FIRST LET ME CLEAR YOU, THERE IS NO PROVISIONS UNDER THE LAW WHICH GIVES US WAY TO WINNING A CASE. MOSTLY A MATRIMONIAL CASES ARE FOUGHT ON THE GROUND OF CRUELTY AND DESERTION. WIFE HAS TO COUNTERBLAST IT BY FILING A SUIT FOR RESTITUTION OF CONJUGAL RIGHTS

what is the stage of your 498-A case. Whether any temporary payment you are receiving in domestic violence. Have you filed any maintenance case separately. Also share the case papers of divorce case filed by your husband. So that proper legal suggestion can be given.
