Husband filed for divorce, but I dont want divorce.

Got married in 2013.hindu marriage act.we both are doing govt job.due to some family issues i filed case in women cell.but problem not solved. They filed domestic violence case against my in laws.then i filled case in court (sec 12..17,18,19,20,23,)and sec 9..but my inlaws not appear in court after 2 month my husband file case against me.divorce. (cruelty and dissertation).but i don't want divorce

Plzzz make cleaR whetheR u hv filed petition undeR sec. 12 oR 9 because both the applications aRe not sustainable at the same time ​in the couRt, 2nd if you have got tje decRee undeR section 9, then they cannot claim the dicoRce on the gRound of deseRtion. So the couRt won't gRant divoRce on the gRound of deseRtion. You can call me on my given contacts oR meet me in high couRt.

hii ... in response of your quary i want to submit that the divorce petition which was filed by husband is the right of his but conversely you can defend that on your part by way of specific reply ( on cruelty and dissertation) and further proceedings of trail.

Your question is not at all clear, whether You are talking on behalf of husband or wife ?
They filed domestic violence case against my in laws.....you have said that they filed case against my in laws. Your in laws are parents of spouse. Why he/she should file case against his/her parents.

As regards the divorce filed by husband or wife.....it is a very lengthy process and decree is not awarded easily. it took ten years to prove cruelty and other grounds to obtain divorce.

My suggestion to you is if spouse is interested in divorce, then don't waste you precious life time for those who have no care for you.

If you settle all things with mutual consent then start proceedings under section 13-B and get decree in 6 months and look for right life partner. Otherwise this thing you will understand when your precious period of life expires.

Rest is your decision.

Courts are not ready to allow Divorce petitions. Court need no from one of the parties unless parties are at Opposite extreme ends leading to divorce. Pursue the Divorce carefully with Professional advice and you ll win positively.
