Husband filed divorce petition, I want my marriage to work, what to do

sir we got married before 1 year and lived to together in joint family with some problem between me and my husband. then i came for my daddy operation that time he filled case for divorce under section (vii) and ( x) but i want live together but he is not willing

Hello Madam, you need not worry about the petition filed by your husband. It cannot be proved easily. You can file the petition for restitution of conjugal right before the court and in the mean while you may seek interim maintenance from your husband to maintain your life. If you have a child or not , its nothing to worry about the matter of divorce filed by your husband. First of all you should know that ,on what grounds your husband filed the petition. Then he should prove all the allegations lodged against you . Apart from that in general no Court's will entertain this kind of matters for separation. Almost all the forums will give much more counseling for rejoining of the parties. Sofar it was the sound health of the indian society. Meanwhile at the time of questioning / trail stage you should stick on your side "for living together".

It was also safe that you should de memorize all your past things that had not digest from you.

As an advice, don't share your personal life tragedy to any one in the society except legal advisors. Because most of the tiny issues had been enlarged by the relatives as well as close friends and the society you live.

Hello,

If you want to live with him then you can file restitution of conjugal rights case against him. This case requesting the case to reunion you with your husband. You also give counter that you are not willing for divorce

You can ask for mediation and try to settle the matter during mediation. If the matter could be mediated you have to contest his petition. Meanwhile You can file a petition for restitution of conjugal rights.

You can file a Counter/Objection to his petition explaining all your facts. You have all the reasons to justify why you went to your parents place. If possible you can go back to your husband's house and stay there. Your husband will have to prove how he is entitle to judicial separation. He will have to prove his case.
