How do I get a divorce if my husband is not willing?
Filing divorce petition. If the husband refuses to grant divorce and the lawyer recommends proceeding with a contested separation, the wife can ask the attorney for a divorce and have it filed in the appropriate court. Even if the husband refuses to grant divorce, a divorce petition may be filed.
How to recover stridhan from husband?
The wife living apart from her husband, even if the separation is judicially decreed, can claim back the stridhan from him under Section 12 of 2005 Protection of Women from Domestic Violence Act.
What proof is required for stridhan?
Stridhan includes any property that was left to her in a will, either by her father or husband, or by another family member. It is not a legal document nor does it have any form of documentation. There was no registration that would label her assets as Stridhan.
