16-Jan-2023 (In Divorce Law)
It's been 4 years of my marriage, I have a 1.5 year old kid. since the day of my marriage my husband was not interested in having a physical relation, I was the one who intiated it as i thought he was shy in that matter but as the days went by he was not able to do anything i realized their was some problem so i tried to discuss it with him many times but he would not listen or react and started abusing me and has hit me for the same reason twice as i did not want to break my marriage i continued being with him as he was fine in other aspects of life, later we had a child also but now again he has started being away from me and when i try to convince him he fights very badly abuses me in front of his parents and has hit me again.he says he does not want to have any relation with me and always says me to leave him, i have no job, my kid is just so small i don't know what to do now. he knows his parents will get him out of legal case as they have money.

As sexual relation is the foundation of marriage, denial of this amounts to cruelty. You may seek divorce on this ground. Simultaneously, you may seek maintenance for yourself, your child and litigation expenses from your husband as per his status.

you will have to claim maintenance from the court and since your child is small you both can get a monthly maintenance from te court as you rightly should. Please file the case as soon as possible so it may be done.

Try to find out the reasons behind the change in him. Try to resolve the matter in mediation and if even then there is no change there are many provisions in law to handle such people. First you have to decide what you want to keep your marriage or divorce as you better know the situation.

You can file a divorce petition on the grounds of cruelty an additional case can be filed for seeking maintainance. You can further file a domestic violence complaint against your husband for beating you.
