Husband does not pay income tax and i have no proof of his income

i filed maintenance and dv case against my husband and in-law . but i dont have any income proof of my husband . but he earn 2000-3000 per day. he is not income tax payee. can i show expenses as proof. i want to know that if i dont have income proof then how can i get maintenance from my husband . i am living at my parents home with my 2 children's from 9 months . please help me.

Which location you have filled case of maintenance & in which location your husband residing, what is business of your husband out of that he earning 2000 - 3000 per day. . .

Whatever data you have regarding his income or expenditure you can file it before the court. The court will consider it. Showing expenditure of your husband also proves his earning capacity.
If your husband earn 2000-3000 per day and is not income tax payee then he will be in trouble. I think you are getting my point what to do.

A default amount of maintenance can be ordered by the Court until you get proofs of his actual income.

Expenses are not conclusive proof of income.

Court can order maintenance according to conditions of both parties.

If you can sufficiently prove his actual source of income and how he receives income of ₹2000-3000 per day, then Court can award you more amount of maintenance.
