Husband asked to leave matrimonial house Can I stay till divorce

24-Jun-2023 (In Divorce Law)
we got married in nov 25 2015, it is not even a year ago. my husband is convinced of the separation. since a Week he asked me to move out and stay somewhere else, to which I agreed and now staying with my brother. I am not comfortable staying here. I have only 10,000 in my account so I can't think of staying elsewhere. my husband offered me to rent an apartment and he will pay for it. but didnt think it was a good idea. I dont want to stay alone. I wish to stay with him until we get divorced. is that my right? will it be an issue? I suspect he is having an affair. what do I do?

Madam,
Being a legally wedded wife you have every right to stay with your husband in his residence till either you get a judicial seperation or divorce. Now you can invoke your right by filing a case against your husband for restitution of conjugal rights and also seek relief under Sections 12, 18, 19, 20 & 22of the Protection of Women From Domestic Violance Act, 2015.
Meanwhile you can also claim maintenance from your husband.
Note: You have not mentioned your religion and the type of marriage whether it comes under Hindu Marriage Act or Special Marriage Act for better advice.

You can stay with him there is nothing wrong with it. The fact that he has convinced you to walk out and reside separately i doubt he will entertain you into the house. You can always get a residence order to ensure he does'nt throw you out of the house.
