Husband and in laws harassed for money I earn what action can I take

H 4visa.I had not even a single penny in US.in nov again in-laws created issue.my husband n in-laws said if I want to go back to parents ,I can.but my parents felt sorry for No reason n requested to carry on.At that time I asked my mother to get FD of the amount I had in my india account including the full n final I received from previous job.my husband was aware of this yet now he called my father for this money too and abused him.I hence came back on 19 May 16.now we decided to get divorced. Please advice what legal action I can take as they spoiled my life and career only for money I earn

Assuming the information provided by you is true and hoping nothing is concealed, I'm proceeding to give my opinion.

Since this query reveals that money which your husband demanded actually belonged to you, and not your parents, this demand cannot be termed as demand of dowry, which is a criminal offence under Indian Criminal Jurisprudence. Beside the fact that your provided information does not reveal any criminal cause of action, you may proceed filing:
1. Complaint under Domestic Violence Act against your husband and in-laws.
2. You may file an application under section 125 Cr.P.C. for maintenance for you and your child (if any).
3. You may proceed filing a petition for restitution of conjugal rights or a divorce petition.

More remedies may be available to you, but that shall only be revealed after a detailed discussion. Hope you got your issue resolved.

you have so many options along with taking divorce then you have other options to take legal action against them and rest if you define rest things then it will be more easy to define because there are different laws and what you think fit you have to tell so rest will define in details thank you

Dear client, you have right to file a criminal complaint of demand of dowry u/s 498a &406 of IPC, you can file another complaint of domestic violence in the court, you are a legal wedded wife so you can also file a petition of maintenance, divorce is a separate issue, but before that you do the above mentioned steps...

Need not to worry, you can file domestic violence case and 498A case and they will be punished as per law and u may get maintenance as well and u may also get divorce you may contact me through law rato
