How to withdraw section 498a case
15-Oct-2023 (In Divorce Law)
Need suggestions on how to proceed further it's been three years now I don't want to continue it anymore
Hi
A 498A case can be closed only by trial or by both parties entering in to a mutual compromise agreement and submitting the same in the High court.
High court under its inherent powers under section 482 of Cr.P.C will then call both the parties and after hearing from both of them will quash the case.

HI,
498-a is compoundable offence. you can withdraw the petition by filing memo or petition in the court in which the proceedings are going on. but once you withdraw the petition it will give strength to your counterpart if he files any divorce petition against you in the family court.
